West Virginia again weighed religious and conscience vaccine exemptions in 2026
West Virginia lawmakers filed many bills in 2026 to add religious and philosophical exemptions to school vaccine requirements, but none passed. The state did enact a homemade food law and an expanded right-to-try law. Bills on homeschool freedom, homeschool sports access, midwife licensing, and fluoride also died when the session ended.
No upcoming West Virginia events listed yet. We add rallies, public hearings, board meetings and other ways to show up as we find them. Know of one? Tell us.
Right to try individualized treatments (signed)
The Safeguard the Right-To-Try Cutting-Edge Medicine Act permits access to individualized treatments for eligible patients.
Patients should be free to pursue promising treatments with their doctors.
Let home cooks sell homemade food (signed)
Authorizes the production and sale of homemade food items under certain circumstances.
Neighbors should be free to buy food made in a home kitchen.
Let homeschoolers join school activities
Permits students taught at home, by a private tutor, or at private or church schools that are not activities-commission members to participate in school activities. Related bills would create a Homeschool Student Athletics Participation Act.
Homeschool families pay taxes too and their children deserve fair access to school activities.
Remove homeschool certification and curriculum rules
Removes requirements for parents' certifications and for a curriculum covering the same subjects as public schools.
Parents, not the state, should direct their children's home education.
License certified professional midwives
Creates licensing and regulation for certified professional midwives.
Families should have access to qualified midwives for home birth.
Add religious and conscience vaccine exemptions
Creates exemptions to mandatory vaccination for religious and philosophical beliefs, revises the medical exemption process, and eliminates the State Immunization Officer position.
Families should not have to choose between their faith or conscience and their child's education.
Stop home visits for new homeschool families
The Child Captivity Prevention Act would require a student education and wellness assurance visit to the home when a family moves to the state and intends to homeschool.
Choosing to homeschool should not trigger a government visit to a family's home.
End fluoride in public water
Disallows adding fluoride to public water systems.
People should decide for themselves what goes into their bodies, including through tap water.
